The Kite Runner Loyalty Program and Competition
OFFICIAL RULES
NO PURCHASE NECESSARY
The Kite Runner Loyalty Program and Competition (the "Promotion")
begins on or about August 30, 2007 and continues through November 2, 2007 (the "Promotion
Period") and is timed to coincide with the theatrical release of the motion
picture the "Kite Runner" (the "Picture") based on the
novel of the same name by Khaled Hosseini (the "Novel"). From August
30, 2007 through November 2, 2007 will be the challenge period (“Challenge
Period”). From August 30, 2007 through October 8, 2007 will be the competition
period (“Competition Period”). The Promotion provides fans with
the opportunity to create individual community groups on the Kite Runner Community
Website -- www.kiterunnermovie.com/club -- (the "Website"). Eligible
persons who follow the instructions to create an individual community group
on the Website are referred to as "Kite Club Captains" in these Official
Rules, and the individual community groups they create are referred to as "Kite
Clubs". Prizes will be awarded to all Kite Club members in Kite Clubs
who reach certain specific membership quotas at the conclusion of the Challenge
Period (the “Challenge”) and to those Kite Club Captains whose
Kite Clubs generate the most activity (“Tracking”) , as more fully
set forth below, during the Competition Period (“the “Competition”).
By participating in the Promotion, each participant unconditionally accepts
and agrees to comply with and abide by these Official Rules and the decisions
of Paramount Vantage, 5555 Melrose Avenue, Hollywood, CA 90038-3197 ("Sponsor"),
which shall be final and binding in all respects.
ELIGIBILITY: Only legal residents of the 50 United States and the District
of Columbia who are eighteen (18) years of age or older are eligible to enter.
Officers, directors, and employees of Sponsor, and each of its parent, subsidiary
and affiliated companies (collectively, the “Promotion Entities”)
are ineligible to participate in the Promotion or win a prize.
HOW TO ENTER:
A. The Challenge. All Kite Clubs must be approved by representatives of Sponsor
prior to being designated as a Kite Club. Sponsor reserves the right to deny
or revoke Kite Club status to any individual community group in its sole and
absolute discretion and any such denial or revocation shall be final and binding
and not subject to challenge or appeal. Kite Club Captains and Kite Club Members
are encouraged to solicit membership for their Kite Clubs by taking advantage
of the tools provided to Kite Club Captains in the Kite Club Captain Promotion
Kit (the “Kit”). Kite Club Captains and Kite Club Members must try
to recruit as many members as possible during the Challenge Period. All persons
who join an individual Kite Club are referred to as "Kite Club Members".
You may be a Kite Club Member of only one Kite Club.
Prizes will be awarded to Kite Club Captains who reach the following quotas (including
Kite Club Captain and all Kite Club Members) at the conclusion of the Challenge
Period, subject to verification of eligibility:
Kite Club Captains of Kite Clubs consisting of 20 - 49 Kite Club Members will
receive a limited edition "Kite Runner" lapel pin. All Kite Club Members
will have the opportunity for the Kite Club Captain and all Kite Club Member
names to be listed in the DVD release of the "Kite Runner" (there is
no retail value associated with this portion of the prize). No casual, inadvertent
or other failure to accord such "credit" shall constitute a breach
of Sponsor's obligations under these Official Rules or otherwise entitle any
winner to any form of legal or equitable relief. The approximate retail value
("ARV") of the prize is $3.
Kite Club Captains of Kite Clubs consisting of 50 - 99 Kite Club Members will
receive a leather bookmark. The ARV of the prize is $10.
Kite Club Captains of Kite Clubs consisting of 100 - 199 Kite Club Members will
be invited to host one (1) private screening of the theatrical release film the "Kite
Runner" for the Kite Club Captain and all of his/her Kite Club Members at
a location in or near the Kite Club Captain’s hometown. The screening must
be scheduled through Sponsor, and the specific date, time and location of the
screening shall be at the sole discretion of Sponsor. In no event shall the screening
be scheduled later than October 30, 2007. The winner and guests are responsible
for transportation to and from the screening. Recording devices will not be allowed
in the screening. In the event that the Kite Club Captain or any of his or her
Kite Club Members engage during the screening in behavior that (as determined
by Sponsor in Sponsor's sole discretion) is obnoxious or threatening, illegal
or that is intended to annoy, abuse, threaten or harass any other person, Sponsor
reserves the right to terminate the screening early, and send the Kite Club Captain
and/or his or her Kite Club Members home with no further compensation. All Kite
Club Members attending the screening will receive a limited edition "Kite
Runner" lapel pin. The ARV of the prize is $1,347.
Kite Club Captains of Kite Clubs consisting of 200 or more Kite Club Members
will receive a copy of the Novel signed by Khaled Hosseini. The ARV of the prize
is $25. B. The Competition. Kite Club Captains will also have the opportunity
to win the Grand, First or Second prize in the Promotion. The winners will be
selected based on tracking of the “Kite Club Activities.” Sponsor
or its designee will track such Kite Club Activities and its determinations relating
to such tracking shall be final and binding and not subject to challenge or appeal. “Kite
Club Activities” consist of the Kite Club Captains' creative use of the
Kits and the amount of activity the Kite Club Captain and Kite Club Members generate
in the Kite Club, including without limitation via postings to the Kite Club
message boards and discussions among Kite Club Members. The Kite Club Captains
who generate the most Kite Club Activity during the Competition Period will win
prizes, as set forth below. Kite Club Activities must be unique and on topic
to the discussion or other activity to qualify towards the Kite Club’s
overall total of Kite Club Activities. All postings must comply with the Terms
of Use policy posted on the Website. Without in any way amending or limiting
such Terms of Use policy, any Submission that is considered by Sponsor to be
obscene, pornographic, libelous or otherwise objectionable will be disqualified
and will not be eligible for entry. Sponsor reserves the right, in its sole and
absolute discretion, to reject, refuse to post or remove any posting by a Kite
Club Member, or to restrict, suspend, or terminate a Member's access to all or
any part of the Website at any time, for any or no reason, with or without prior
notice or warning, and without liability. Sponsor expressly reserves the right,
but not the obligation, to remove a Kite Club Member's profile and/or restrict,
suspend, or terminate a Kite Club Member's access to any part of the Website
if Sponsor determines, in its sole and absolute discretion, that a Kite Club
Member poses a threat to Sponsor, the Website or its Members, that a Kite Club
Member's conduct or postings are obnoxious or threatening, illegal or that is
intended to annoy, abuse, threaten or harass any other person, or for any other
reason. All Submissions or other materials and personal information submitted
as part of the Promotion may be shared by and between the Promotion Entities,
and each of the Promotion Entities will use such information in accordance with
their respective independent online privacy practices. Except as otherwise stated
in these Official Rules, personal information collected in connection with this
Promotion will be used in accordance with Sponsor's privacy policy, which can
be found at www.paramount.com/paramount.php, and with the consent given by the
entrant at the time of entry. Any communication or information transmitted to
Sponsor and/or the Website by electronic mail or otherwise is and will be treated
as non-confidential and nonproprietary. All Submissions become the exclusive
property of Sponsor and will not be returned or acknowledged. Proof of submitting
a Submission is not considered proof of delivery to or receipt of such entry.
Furthermore, Sponsor shall have no liability for any Submission that is lost,
intercepted, not judged or not received by the Sponsor.
COMPETITION WINNER NOTIFICATION: The potential winners will be notified by telephone
and/or mail and/or email using the contact information provided at the time of
registration. Sponsor shall have no liability for any winner notification that
is lost, intercepted or not received by the potential winners for any reason.
If, despite reasonable efforts, a potential winner does not respond within twenty-four
(24) hours of the first notification attempt, or if the prize or prize notification
is returned as unclaimed or undeliverable to such potential winner, such potential
winner will forfeit his or her prize and an alternate winner may be selected.
If any potential winner is found to be ineligible, or if he or she has not complied
with these Official Rules or declines a prize for any reason prior to award,
such potential winner will be disqualified and an alternate may be selected.
Sponsor may successively attempt to contact up to two (2) potential winners (at
any given prize level) in accordance with such procedure, and if there is still
no confirmed winner of a prize after such attempts have been made, if any, the
prize may go unawarded.
DATES & DEADLINES/ANTICIPATED NUMBER OF CONTESTANTS AND/OR KITE CLUB MEMBERS:
Because of the unique nature and scope of the Competition and Challenge, Sponsor
reserves the right, in addition to those other rights reserved herein, to modify
any date(s) or deadline(s), or reduce the number of Kite Club Members needed
to reach the threshold levels set forth in these Official Rules. Sponsor cannot
accurately predict the number of entrants who will participate in the Promotion.
PUBLICITY RELEASE: By participating in the Promotion, in addition to any other
grants which may be granted in any other agreement entered into between Sponsor
and any entrant in or winner of the Promotion, each entrant irrevocably grants
the Promotion Entities and their respective successors, assigns and licensees,
the right to use such entrant's name, likeness, and biographical information,
and any individual(s) participating therein, in any and all media (including,
without limitation, as a featured profile on the Website) for any purpose, including
without limitation, advertising and promotional purposes as well as in, on or
in connection with the Website, the Promotion or other promotions related to
the Picture, and hereby release the Promotion Entities from any liability with
respect thereto.
COMPETITION PRIZES: One (1) Grand Prize is available. The Grand Prize consists
of a four (4) day/three (3) night trip for the Grand Prize winner and one (1)
travel companion each to San Francisco, CA and the opportunity for winner and
one (1) guest each to have dinner with Khaled Hosseini, the author of the “Kite
Runner.” The Grand Prize includes round-trip, coach-class airfare for the
Grand Prize winner and his/her travel companion between the major airport nearest
winners’ home and San Francisco, CA; three (3) nights’ accommodations
(single room, double occupancy); and ground transportation between the hotel
and the dinner. The approximate retail value ("ARV") of the Grand Prize
is $1,800 ea.
In the event that the dinner listed in the Grand Prize description does not or
cannot take place as scheduled or at all, for reasons included but not limited
to scheduling conflicts, cancellations, postponement, an event of “Force
Majeure” (defined below), or for any other reason, then in lieu of attending
the dinner, Grand Prize winners will receive One Hundred Dollars ($100), and
such amount plus the remaining components, if any, of the Grand Prize shall constitute
full satisfaction of Sponsor’s prize obligation to the Grand Prize winner,
and no other or additional compensation will be awarded. Excepting the preceding
sentence, no cash alternative or prize substitutions will be allowed, except
Sponsor reserves the right to substitute prize(s) of comparable value if a prize
listed is unavailable for any reason. Applicable portions of the Second Prize
will be delivered only to an address in the United States.
Five (5) First Prizes are available. The First Prize consists of a four (4) day/three
(3) night trip for the First Prize winner and one (1) travel companion to Los
Angeles, CA, to attend the “Kite Runner” premiere. The First Prize
includes round-trip, coach-class airfare for each First Prize winner and his
or her travel companion between the major airport nearest each winner's home
and Los Angeles, CA; three (3) nights’ accommodations (single room, double
occupancy); two (2) tickets to the “Kite Runner” premiere; and ground
transportation between the hotel and the premiere. The approximate retail value
("ARV") of the First Prize is $1800 ea. The “Kite Runner” premiere
in Los Angeles, CA is currently anticipated to be held on October 25, 2007. The
First Prize trip must be taken to coincide with this date, or the rescheduled
date if the premiere is rescheduled, or the First Prize will be forfeited in
its entirety. Nothing set forth herein shall be construed to require Sponsor
to hold a premiere of the movie at any particular time, or at all. In the event
that the movie premiere listed in the First Prize description does not or cannot
take place as scheduled or at all, for reasons included but not limited to scheduling
conflicts, cancellations, postponement, an event of “Force Majeure” (defined
below), or for any other reason, then in lieu of attending the premiere, the
First Prize winners will receive One Hundred Dollars ($100), and such amount
plus the remaining components, if any, of the First Prize shall constitute full
satisfaction of Sponsor’s prize obligation to the First Prize winners,
and no other or additional compensation will be awarded. Excepting the preceding
sentence, no cash alternative or prize substitutions will be allowed, except
Sponsor reserves the right to substitute prize(s) of comparable value if a prize
listed is unavailable for any reason. Applicable portions of the First Prize
will be delivered only to an address in the United States. (5) Second Prizes
are available. The Second Prize consists a "Kite Runner" movie poster
autographed by Marc Forster. The approximate retail value of the Second Prize
is $90 ea.
TRAVEL PRIZE CONDITIONS: The applicable winners and their travel companion must
all be eighteen (18) years of age or older in order to redeem the travel prize
and participate in the prize activities. The applicable prize winners and their
travel companions must travel together on the same itinerary and possess all
required travel documents, including visas and valid passports, if and as applicable.
All aspects of the travel portions of the prize must be conducted on such dates
as determined by Sponsor in its sole discretion. The dates of departure and return
are subject to change at Sponsor’s sole discretion. Airfare may not include
government taxes, Passenger Facility Charge or September 11th Security Fee. Airline
tickets are non-refundable/non-transferable and are not valid for upgrades and/or
frequent flyer miles. Other travel restrictions may apply. All airline tickets
are subject to the vagaries of flight variation, work stoppages, and schedule
or route changes. ARV for travel prizes may vary depending upon points of departure
and destination and fare fluctuations. Sponsor reserves the right to structure
travel route and select hotels in their sole discretion. If the closest airport
to a prize winner’s home is in close enough proximity to prize destination
city so that, as Sponsor may determine in its sole discretion, a flight is unnecessary,
such prize winner will receive alternate transportation from the Sponsor with
no further obligation to the winner. The ARV for travel prizes is an estimate
made before the Promotion begins. The prize winners will not receive cash or
any other form of compensation if actual travel costs are less than the estimate
made in these Official Rules. The round trip air transportation element for any
travel prize begins and ends at the point of departure. In the event a prize
winner and/or his or her travel companion engage in behavior that (as determined
by Sponsor in Sponsor’s sole discretion) is obnoxious or threatening, illegal
or that is intended to annoy, abuse, threaten or harass any other person, Sponsor
reserves the right to terminate the trip or other applicable experience early,
in whole or in part, and send such prize winner and/or his or her travel companion
home with no further compensation.
GENERAL PRIZE CONDITIONS: All details and other restrictions of prizes not specified
in these Official Rules will be determined by Sponsor in its sole discretion.
Prizes are non-assignable and non-transferable. No cash alternative or prize
substitutions will be allowed, except Sponsor reserves the right to substitute
prize(s) of comparable value if the prizes listed or any component of any prize
listed is unavailable for any reason. Any prizes depicted in promotional packaging
or otherwise in connection with this Promotion are for illustrative purposes
only and may not represent the actual prize(s) that is (are) awarded. In the
event there is a discrepancy or inconsistency between disclosures or other statements
contained in any Promotion promotional materials and the terms and conditions
of these Official Rules, these Official Rules shall prevail and govern. The prize
winners shall be solely responsible for all federal, state and/or local taxes,
and the reporting consequences thereof, and for any other fees or costs associated
with the applicable prize. The potential prize winners may be required to execute
an Affidavit of Eligibility, a Liability Release, and (where legal) a Publicity
Release (collectively, "Prize Claim Documents"). If a winner is considered
a minor in his or her state of residence, at Sponsor’s option, the applicable
prize either will be awarded in the name of the parent or legal guardian of the
winner, or the parent or legal guardian of the winner will be required to ratify
and sign the Prize Claim Documents. Time is of the essence in awarding the Competition
Prizes and the Screening Challenge Prize. Accordingly, if a winner (or, in the
case of a minor, such minor's winner's parent or legal guardian) fails or refuses
to sign and return all Prize Claim Documents within seven (7) days of prize notification
(or a shorter time if required by exigencies), the winner may be disqualified
and the next runner up may be selected as an alternate winner.
GENERAL LIABILITY RELEASE/FORCE MAJEURE: Entrants (or if minors, their parents
or legal guardians) agree that the Promotion Entities (A) shall not be responsible
or liable for any losses, damages or injuries of any kind resulting from participation
in the Promotion or any Promotion-related activity, or from entrants’ acceptance,
receipt, possession and/or use or misuse of the prize(s), and (B) have not made
any warranty, representation or guarantee express or implied, in fact or in law,
with respect to the prize(s), including, without limitation, to such prize’s
quality or fitness for a particular purpose. Sponsor assumes no responsibility
for any damage to a participant’s computer system which is occasioned by
accessing the Website or participating in the Promotion, or for any computer
system, phone line, hardware, software or program malfunctions, or other errors,
failures, delayed computer transmissions or network connections including without
limitation, those that are human or technical in nature. Without limiting the
generality of the foregoing, Sponsor is not responsible for lost, interrupted,
inaccessible or unavailable networks, servers, satellites, Internet Service Providers,
websites, or other connections; or for miscommunications, failed, jumbled, scrambled,
delayed, or misdirected computer, telephone or cable transmissions; or for any
technical malfunctions, failures, difficulties or other errors of any kind or
nature; or for the incorrect or inaccurate capture of information, or the failure
to capture any information. Sponsor reserves the right in its sole discretion
to disqualify any individual who is found to be tampering with the participation
process or the operation of the Promotion or the Website, to be acting in violation
of these Official Rules, or to be acting in an unsportsman-like or disruptive
manner, or with the intent to disrupt or undermine the legitimate operation of
the Promotion, or to annoy, abuse, threaten or harass any other person, and Sponsor
reserves the right to seek damages and other remedies from any such person to
the fullest extent permitted by law. In the event Sponsor is prevented from awarding
prize(s) or continuing with the Promotion as contemplated herein by any event
beyond its control, including but not limited to fire, flood, natural or man-made
epidemic of health of other means, earthquake, explosion, labor dispute or strike,
act of God or public enemy, satellite or equipment failure, riot or civil disturbance,
terrorist threat or activity, war (declared or undeclared) or any federal state
or local government law, order, or regulation, public health crisis (e.g. SARS),
order of any court or jurisdiction, or other cause not reasonably within Sponsor’s
control (each a "Force Majeure" event or occurrence), then subject
to any governmental approval which may be required, Sponsor shall have the right
to modify, suspend, or terminate the Promotion. If the Promotion is terminated
before the designated end date, Sponsor will (if possible) select the Competition
winners from all eligible, non-suspect Kite Club Captains participating as of
the date of the event giving rise to the termination. These Official Rules cannot
be modified or amended in any way except in a written document issued in accordance
with law by a duly authorized representative of Sponsor. The invalidity or unenforceability
of any provision of these rules shall not affect the validity or enforceability
of any other provision. In the event that any provision is determined to be invalid
or otherwise unenforceable or illegal, these rules shall otherwise remain in
effect and shall be construed in accordance with their terms as if the invalid
or illegal provision were not contained herein.
WINNERS LIST/OFFICIAL RULES: To obtain a copy of any legally-required winners
list, send a self-addressed stamped envelope to The Kite Runner Loyalty Program
and Contest Winners List, 5555 Melrose Avenue, Hollywood, CA 90038-3197. All
such requests must be received no later than six (6) weeks after the end of the
Entry Period. These Official Rules will be posted on the Website.
